We examine the role of professional jurisdiction in the convergence of science and business by exploring the relationship between professional jurisdiction and ethical decision-making. We apply the concept of professional jurisdiction (Abbott 1988) to the turf wars over vertebrate fossils among professional fossil collectors, vertebrate paleontologists, and the professional associations. We posit a series of hypotheses relating to how perceptions of professional jurisdiction influence stakeholders’ ethical decision-making frameworks concerning the sale and purchase of vertebrate fossils, as well as how (...) professional paleontologists who work with vertebrate fossils and other stakeholders differ in ethical decision-making if vertebrate fossils are perceived inside or outside of their professional jurisdiction. We develop a time-line of jurisdiction battles over vertebrate fossils and a model of the influence of professional jurisdiction perceptions on ethical decision-making. Over the past three or four decades, the concept of medical ethics has changed from a limited set of standards to a broad field of debate and research. We define medical ethics as an arena of moral issues in medicine, rather than a specific discipline. This paper examines how the disciplines of health care ethics and health care law have developed and operated within this arena. Our framework highlights the aspects of jurisdiction (Abbott) and the assignment of responsibilities (Gusfield). (...) This theoretical framework prompted us to study definitions and changing responsibilities in order to describe the development and interaction of health care ethics and health law. We have opted for the context of the Dutch debate about end-of-life decisions as a relevant case study. We argue that the specific Dutch definition of euthanasia as 'intentionally taking the life of another person by a physician, upon that person's request' can be seen as the result of the complex jurisdictional process. This illustrates the more general conclusion that the Dutch debate on end-of-life decisions and the development of the two disciplines must be understood in terms of mutual interaction. (shrink)

This remarkable collection of period photographs details day-to-day life and changing times in the Deep South. Draffus Lamar Hightower, 1899-1993, spent most of his life in Barbour County, Alabama. For many years he was the owner of a Chevrolet dealership, but he had another occupation as well. From his youth, he was fascinated with photography, and for fifty years he experimented with the craft both technically and artistically. Hightower, while participating fully in the 20th century, was also acutely aware of (...) the passing of the heritage of the last one. From the early 1920s to the late 1960s, he made thousands of negatives of people, events, landscapes, objects, and buildings in Barbour County. His photographs are reminiscent of the documentary work of Walker Evans, Berenice Abbott, and other great 20th-century American photographers. Hightower created an incredibly complete and vivid record of the life of a rural Alabama county during a period of profound change-documenting everything from birthday parties and political rallies to farm scenes and the demolition of historic buildings so that future generations would not forget the world of their forebears. In 1990, Michael Thomason, historian and photographic archivist, began the long process of reviewing Hightower's collection of photographs, interviewing family and friends, and salvaging and printing the negatives, which by that time had begun to deteriorate. Thomason restored and printed 195 photographs and prepared accompanying essays that not only reveal the technical details of Hightower's labor of love but also tell the story of the human and economic changes in Barbour County during this period. Reparations whether to blacks for slavery, or to Indians for land theft, or to settle any number of other conflicts, has an interesting political background. Analysts on the left, who are usually no friend of private property rights, nevertheless rely on this doctrine to support their case for reparations. Those on the right, in contrast, who supposedly defend the institution of property rights, jettison them when it comes to reparations. It is only libertarians, such as the present authors, who both (...) favor private property rights in general, and, also, apply them to the issue of reparations, who are logically consistent. This would have been a better book if Sampson had argued his main point, the usefulness of the Simonian principle as an explanation of the evolution, structure, and acquisition of language, on its own merits, instead of making it subsidiary to his attack on ‘limited-minders’ (e.g., Noam Chomsky). The energy he has spent on the attack he might then have been willing and able to employ in developing his argument at reasonable length and detail. He might then have found that (...) argument faulty, or even wrong. Underdeveloped as it is, however, his point about the Simonian principle does seem to have thepossibility of some significance in understanding the empirical issues of this book (and the dichotomy of ‘limited’ and ‘creative’ minds is certainly not one of these).What Sampson has done inMaking Sense has the appearance of science, and theoretical linguistics, and therefore it is somewhat puzzling to find the conclusions that the human mind cannot be scientifically studied (p. 10), and that theoretical linguistics is a “mirage” (p. 210). His statement that It may still seem worthwhile to some to work out the exact implications for present-day linguistic structure of the fact that languages are evolved systems, but I cannot see that there is much glamour or, indeed, much substance in this task (p. 210) would surely be surprising to a geneticist or ethologist. We hope his apparent misunderstanding on this point will not lead him to give up his profession, in which he seems willing and able to make a significant contribution.What in particular is required is a clear indication of how the Simonian principle imposes itself in the ontogenesis of language. Consider Chomsky's example of the rule for forming questions in English. For sentence (1) below, children able to deal with such examples would give (2) but not (3) as the corresponding question (Chomsky, 1975, p. 31).The man who is tall is in the room.Is the man who is tall in the room?*Is the man who tall is in the room?Now compare Sampson's evolutionary explanation for the structure-dependence of rules which is illustrated in (1)-(3): “once a behavior-pattern has become thoroughly established, it will tend to be treated as a fixed given when used as a constituent of a more complex, later-learned behavior-pattern” (p. 183). In order for this to account for Chomsky's example it would have to be the case that children learn relative clauses before they learn questions, which simply isn't true.In conclusion, we wish not to seem unaware of the problems with the position Sampson is attacking, or unaware of the sometimes dogmatic way it too has been presented. Chomsky's hypothesis of innate linguistic ideas seems, fundamentally, to derive from the claimed rapidity and uniformity of language acquisition in the face of limited and degenerate data. Chomsky appears to have been unwilling to argue these points directly or to show their relation to others, for which he has argued, for example, the implausibility of some abstract constraint's having been learned (cf. 1971, pp. 22–44; 1975, pp. 30–33; 1980, pp. 35–52). And almost from his first invoking of rationalism in support of his linguistic method, Chomsky has himself resorted to an unnecessarily polemical attack on empiricism (cf. 1965, p. 58, n. 33). I like Bill Maher . He takes sides. One of his best recent lines was, "the last time the Republicans had that many black folks on stage they were selling them!" (That was in response to the reportedly large number of black folks carrying the Republican banner at the 2004 RNC.) The historical irony is that the folks who did the bulk of the selling of black folk would have been predecessors of today’s Democrat party. (So, Maher is evidently no (...) history buff.) Gains in moral judgement, as measured by the Defining Issues Test (DIT), correlate strongly with advancing education. Curricula that are strongly biblically based may not promote, and students with a strong fundamentalist orientation may not demonstrate, such moral growth. Students at an interdenominational, but very conservative seminary, completed the DIT before and after ethics courses conducted in three different formats. Those students who spent 30 hours in small‐group discussions of ethical dilemmas improved their moral reasoning scores, while those who had (...) fewer hours of discussion or lectures did not. It would appear that small group discussions, shown to improve moral reasoning scores in other educational settings, are also successful in a strongly biblical environment. (shrink)

Why are bookstore shelves filled with mysteries, horror stories, romances, Westerns and other genre fiction? Why should one spend time reading narratives that are so similar? Why, for that matter, should one write works that are so similar to those of other authors? One philosopher, Noel Carroll, in fact, refers to the phenomenon as the ?paradox of junk fiction?. Are there works in political theory as well that share characteristics with these genres? And is there also a paradox involved among (...) both these readers and authors? This essay reviews both the criticisms and defenses of popular generic texts focusing on arguments that defend the complexity of genre texts and those that deny the distinction between generic works and others. Utopias are identified as counterparts in political theory and are applied to this genre debate. I conclude by revising the genre paradox. (shrink)

The subtlety and power of Raz's reflections on ethical topics make his writings a fertile source for anyone working in this area. Especially significant are his (...) explorations of the connections between practical reason and the theory of value, which constitute a sustained and penetrating treatment of a set of issues at the very center of moral philosophy as it is practiced today. The contributors to the volume acknowledge the importance of Raz's contributions by engaging critically with his positions and offering independent perspectives on the topics that he has addressed. The Nature of God explores a perennial problem in the philosophy of religion.

Purpose This paper aims to provide a non-academic perspective on the research reports of the JICES “Post-Snowden” special edition, from the viewpoint of a privacy advocate with an IT background. Design/methodology/approach This paper was written after reviewing the country reports for Japan, New Zealand, PRC and Taiwan, Spain and Sweden, as well as the Introduction paper. The author has also drawn on online sources such as news articles to substantiate his analysis of attitudes to technical privacy protection post-Snowden. Findings Post-Snowden, (...) the general perception of threats to online privacy has shifted from a predominant focus on commercial threats to a recognition that government activities, in the sphere of intelligence and national security, also give rise to significant privacy risk. Snowden’s disclosures have challenged many of our assumptions about effective oversight of interception capabilities. Citizens’ expectations in this regard depend partly on national experience of the relationship between citizen and government, and can evolve rapidly. The tension between legitimate law enforcement access and personal privacy remains challenging to resolve. Originality/value As a “viewpoint” paper, this submission draws heavily on the author’s experience as a privacy and technology subject-matter expert. Although it therefore contains a higher proportion of opinion than the academic papers in this issue, his hope is that it will stimulate debate and further research. (shrink)

Decades of psychological research have been aimed at modeling how people learn features and categories. The empirical validation of these theories is often based on artificial stimuli with simple representations. Recently, deep neural networks have reached or surpassed human accuracy on tasks such as identifying objects in natural images. These networks learn representations of real‐world stimuli that can potentially be leveraged to capture psychological representations. We find that state‐of‐the‐art object classification networks provide surprisingly accurate predictions of human similarity judgments for (...) natural images, but they fail to capture some of the structure represented by people. We show that a simple transformation that corrects these discrepancies can be obtained through convex optimization. We use the resulting representations to predict the difficulty of learning novel categories of natural images. Our results extend the scope of psychological experiments and computational modeling by enabling tractable use of large natural stimulus sets. (shrink)
